The commented judgement is important for the development of civil society at the local level. It concerns an issue related to the direct exercise of power by citizens through the institution of the local referendum. The Author analyses the manners of publicising the subject of the local referendum and its adaptability to modern communication solutions. In this respect, the regulation in question requires the intervention of the legislator, which has been raised as a postulate de lege ferenda. The second problem analysed is the excessive rigor in the commission’s examination of personal data, which may result in a limitation of the constitutional right of residents to participate in the local referendum.
